TERMS OF SERVICE

Welcome to Spike Durian (“we”, “us”, “our”). We operate this website and online store to provide premium Pahang Mao Shan Wang durians preserved with Agrifreeze technology (“Products”). By accessing or using our Services, you agree to be bound by these Terms of Service (“Terms”).

Please read these Terms carefully. If you do not agree, you should not access or use the Services.


SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your jurisdiction. You agree to provide accurate, current and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account and all activity under your account.


SECTION 2 – OUR PRODUCTS

  • All durians sold are premium Pahang Mao Shan Wang, sourced directly from Malaysia.

  • Products are preserved using Agrifreeze’s patented freezing technology, formulated to retain fresh texture, flavour, and aroma.

  • Standard packaging contains around 400g of durian flesh per box (unless otherwise stated).

  • Once thawed, durians must be consumed within 12–24 hours. Do not refreeze.

We make every effort to display accurate product images; however, colours and textures may vary slightly due to device settings. All product descriptions are subject to change without notice.


SECTION 3 – ORDERS

By placing an order, you make an offer to purchase our Products. We reserve the right to accept or decline any order.
Your order is only accepted once we issue an order confirmation.

All purchases are subject to our Return & Refund Policy.

Orders are for personal use only and may not be resold.


SECTION 4 – PRICES & PAYMENT

  • All prices are listed in Singapore Dollars (SGD).

  • Payment methods include credit/debit cards via secure checkout.

  • Delivery fees apply as stated at checkout.

  • Promotional codes cannot be combined unless explicitly stated.

You agree that all payment information provided is accurate and that charges will be honoured.


SECTION 5 – SHIPPING & DELIVERY TERMS

5.1 Delivery Schedule

Deliveries operate Friday, Saturday, and Sunday.
Delivery slots: 12:00–18:00 and 18:00–22:00.

5.2 Delivery Fees
  • Single-box orders: $10 delivery fee.

  • Free delivery for orders of 3 boxes or more (if applicable).

  • Re-delivery fee: $10 for any failed delivery attempt.

5.3 Delivery Requirements
  • As Products are chilled and perishable, someone must be present to receive the delivery.

  • We do not leave durians at the door or unattended.

  • Once handed over, responsibility for proper storage lies with the customer.

5.4 Delivery Areas

We deliver across Singapore. Surcharges may apply for restricted-access areas such as Sentosa, Airline House, Changi vicinity, and Tuas.

5.5 No Same-Day Delivery

We require a preparation window; same-day delivery is not available.
Next-day delivery (Fri–Sun only) requires orders placed before 5pm.

5.6 Delivery Condition

Durians are delivered chilled, packed with gel ice packs.
Customers must refrigerate immediately upon receipt.


SECTION 6 – STORAGE & HANDLING

Customers are responsible for proper storage after delivery:

  • Refrigerate immediately.

  • Consume within 12–24 hours for best quality.

  • Do not refreeze—texture and flavour degradation will occur.

  • If left at room temperature for >12 hours, the Product is considered mishandled and not eligible for replacement.

Failure to follow these instructions voids replacement eligibility.


SECTION 7 – ORDER ISSUES & QUALITY CLAIMS

If you receive a defective or incorrect order, contact us within 24 hours at hello@spikedurian.sg.

7.1 Verification Checklist (Required for Replacements)

You must confirm that:

  • Durians were kept chilled upon delivery.

  • They were consumed within 12–24 hours.

  • They were not refrozen.

  • They were not left unrefrigerated for long periods (>12 hours).

  • They were not tampered with or repacked.

Provide photos/videos of the issue to expedite review.

7.2 Exclusions

We do not replace or refund:

  • Products mishandled after delivery

  • Subjective taste preferences

  • Orders not received due to customer absence

  • Quality degradation occurring beyond 24 hours

  • Items left at ambient temperature for extended periods

All claims are evaluated case-by-case.


SECTION 8 – CANCELLATIONS & ORDER CHANGES

  • Orders may be cancelled up to 2 days before the scheduled delivery.

  • No cancellations within 1 day of delivery.

  • Delivery address changes must be made 2 days in advance.

  • Contact hello@spikedurian.sg for cancellations or changes.


SECTION 9 – OPTIONAL TOOLS & THIRD-PARTY SERVICES

Some tools or integrations may be provided by Shopify or other third parties.
Use of such tools is at your own risk.
We are not responsible for issues arising from third-party services.


SECTION 10 – INTELLECTUAL PROPERTY

All text, images, logos, product descriptions, and trademarks on the Services belong to Spike Durian and are protected by applicable IP laws.

You may not copy, distribute, modify, or create derivative works without written permission.


SECTION 11 – PRIVACY POLICY

All personal information submitted through the Services is governed by our Privacy Policy.
Shopify may also process your data per their privacy terms.


SECTION 12 – DISCLAIMER OF WARRANTIES

Products are provided “as is” and “as available.”
We do not warrant uninterrupted, error-free service or guarantee any particular outcome.


SECTION 13 – LIMITATION OF LIABILITY

Spike Durian is not liable for:

  • Delays beyond our control (weather, courier issues)

  • Product quality issues resulting from improper storage

  • Allergic reactions or dietary issues

  • Losses related to third-party tools or platforms

To the fullest extent permitted by law, we disclaim all indirect, incidental, or consequential damages.


SECTION 14 – INDEMNIFICATION

You agree to indemnify and hold harmless Spike Durian and Shopify from claims arising out of your breach of these Terms or misuse of the Services.


SECTION 15 – SEVERABILITY

If any portion of these Terms is found unlawful or unenforceable, the remaining provisions will continue in full force.


SECTION 16 – GOVERNING LAW

These Terms are governed by the laws of Singapore.
You agree to submit to the exclusive jurisdiction of Singapore courts.


SECTION 17 – CHANGES TO TERMS

We may update these Terms at any time by posting revisions on this page. Continued use of the Services constitutes acceptance of the updated Terms.
